Questioning Witnesses Question:
Does an employee facing disciplinary action have the right to question a witness in person?
Answer:
The employee should be given an opportunity to question and raise points about any information that has been provided by witnesses.
However, this does not necessarily mean they should be allowed to question them face to face or in the disciplinary meeting. In some cases, it may not be reasonable if the witness is not available or unwilling to be questioned directly. As an alternative to face to face questioning of witnesses, you could allow the ‘accused' employee to put any questions they have to the witness in writing.
